Retail Studio

These Terms of Use ("Terms") govern access to and use of the Retail Studio platform (the "Service"), operated by CRE Studio, LLC ("CRE Studio," "we," "us," or "our").

By accessing or using the Service, you agree to these Terms.

1. Who this platform is for

Retail Studio is a business-to-business platform. Accounts are created and provisioned by CRE Studio for approved customers and their authorized users.

You must be authorized by your company to use the account assigned to you.

2. What the platform does

Retail Studio allows users to:

• Upload and enter data and information
• Generate reports and other content using AI tools
• (In the future) build AI agents

You may share your outputs anywhere you choose.

3. Your data

What you may upload

You may upload business data, client data, and limited personal data of employees or business contacts where you have a lawful business purpose and legal right to do so. You may not upload personal social media profile data of consumers that you do not own or control.

You are responsible for:

• Having proper consent and legal authority
• Complying with all applicable privacy and data protection laws
• The accuracy and legality of the data you provide

Ownership

• You own your input data.
• You own the outputs generated for you by the platform.

Our limited use

CRE Studio may use your data and outputs only in anonymized and aggregated form to:

• Improve the Service
• Maintain system performance
• Develop features

We do not train models on your identifiable data.

Platform Data Compliance

Use of Facebook and Instagram data through the Service is governed by Meta’s Platform Terms and Developer Policies. CRE Studio processes such data solely on behalf of the authorized business customer and in accordance with those policies.

4. Acceptable use

You agree not to use the Service for:

• Any illegal activity
• Training or supporting weapons, military systems, or surveillance systems
• Providing medical or legal advice to others
• Reverse engineering, copying, or attempting to extract the platform, models, or source code
• Building competing products using the Service or its outputs as training data
• Scraping, automated harvesting, or bulk extraction of system data

We may suspend or terminate access immediately if these rules are violated.

5. Commercial use of outputs

You may use your outputs for commercial business purposes, including internal reporting, client deliverables, and decision-making.

You are responsible for reviewing outputs before relying on them.

6. AI limitations

The Service uses automated systems and artificial intelligence.

This means:

• Outputs may be incomplete or incorrect
• Outputs are not professional advice
• You must independently verify important information

CRE Studio is not responsible for business, legal, medical, or financial decisions made using outputs.

7. Our intellectual property

We own:

• The platform
• The software
• The models
• The interface
• The branding and documentation

These are protected by copyright and other laws. You receive a limited, non-transferable right to use the Service during your account term.

8. Account access and termination

CRE Studio may suspend or terminate access to the Service at any time, without notice, if:

• These Terms are violated
• Use creates legal or security risk
• Required by law

Upon termination, your access ends immediately.

9. Availability

We try to keep the Service available but do not guarantee:

• Uptime
• Error-free operation
• Continuous availability

Features may change over time.

10. Disclaimers

The Service is provided "as is."

We make no warranties that:

• The platform will meet all needs
• Outputs will be accurate
• The Service will be uninterrupted

11. Limitation of liability

To the maximum extent allowed by law, CRE Studio is not liable for indirect, incidental, or consequential damages, including:

• Lost profits
• Lost data
• Business interruption

Our total liability will not exceed the amount paid to us for the Service in the previous 12 months.

12. Indemnification

You agree to defend and indemnify CRE Studio from claims arising from:

• Your uploaded data
• Your misuse of the Service
• Your violation of these Terms

13. Dispute resolution

Arbitration first

Any dispute must first be resolved through binding arbitration.

Governing law

These Terms are governed by the laws of the State of Colorado, excluding conflict-of-law rules.

14. Changes to these Terms

We may update these Terms from time to time. Continued use of the Service means you accept the updated Terms.
